Rollover Accidents in Fort Myers and elsewhere in South Florida frequently lead to very serious or fatal injuries. Ejection injuries, spinal cord injuries, traumatic brain injuries and crushed limbs are too often the result.
At Associates and Bruce L. Scheiner, Attorneys for the Injured, we have the personal injury trial lawyers and the experience handling wrongful death litigation that is so often necessary to fight for a victim’s rights following a rollover crash. Our team of investigators, registered nurses and other legal and medical experts will review all of the facts and circumstances of your case and decide upon the best course of action.
Our Fort Myers Car Accident Lawyers know there are many factors that make these complex cases. Frequently, defective vehicle claims or issues with passenger restraint are involved – either because of a legitimate claim on the part of the plaintiff or because defense attorneys attempt to mitigate their client’s liability. And, in cases involving serious or fatal injury, insurance carriers understand the stakes are high and typically mount an aggressive defense.
The National Highway Traffic Safety Administration reports rollover accidents are responsible for about one-third of all traffic fatalities, despite accounting for just 3 percent of all accidents. As a result, the government announced new ejection mitigation standards in early 2011 that aimed to help prevent these devastating crashes.
The new standards began in 2013 and required vehicle manufacturers to take steps to prevent unbelted passengers from moving more than 4 inches beyond the side window in the event of a crash. This will likely include the use of Side Curtain Airbags, though the government report found the devices failed to prevent ejection through a side window in a significant number of crashes.
Government estimates put the number of lives saved by the new standards at nearly 400 per year.
